ELKINS, W.Va. (AP) — An 82-year-old Randolph County man accused in the shooting death of his wife has been found not competent to stand trial.
The Inter-Mountain reports (http://bit.ly/UVpHO7 ) that Circuit Judge Jaymie Wilfong issued the ruling in Theodore Yeager Newlon's case Thursday.
Newlon was indicted one count of murder and one count of wanton endangerment after the Feb. 6 shooting of 69-year-old Dora Lee Newlon.
Three of four mental health professionals who testified at a Dec. 7 hearing deemed Newlon incompetent to stand trial. One said he diagnosed Newlon with delirium, epilepsy and dementia.
Wilfong left open the possibility that Newlon's competence can be restored. The judge ordered a re-evaluation by the four experts and set another hearing for Feb. 8.
