CHARLESTON, W.Va. (AP) — An Elkview woman who admitted she fatally shot her estranged husband in his hospital bed has been sentenced to home confinement.
Media outlets report a Kanawha County circuit judge sentenced 56-year-old Rhonda K. Stewart to 10 to 40 years of home confinement Tuesday, with credit for time spent in jail and at home.
Stewart pleaded guilty last month to second-degree murder for the 2009 shooting of Sammy Stewart. He was killed at a Charleston Area Medical Center intensive-care unit while being treated for pancreatitis.
In 2011, the state Supreme Court ordered a new trial. Rhonda Stewart had been sentenced previously to life in prison with the possibility of parole for first-degree murder, but the justices ruled the jury should have heard claims she had been abused throughout their 38-year marriage.
