BRISTOL, Va. (AP) — A man facing a capital murder charge in Bristol, Va., is free after the prosecution's key witness recanted.
Anthony Jemes Jr. had been held in the Bristol jail without bond since his arrest in July 2011.
Media outlets report that a Bristol Circuit Court judge dismissed the murder charge, along with a robbery charge on Wednesday.
Jemes and 20-year-old co-defendant Daniel A. Henry were charged with killing and robbing 86-year-old Annie Smith in her apartment on July 9, 2011.
Henry pleaded guilty in September 2012 and is serving a 35-year sentence.
Henry had claimed that Jemes was involved in Smith's slaying.
Commonwealth's Attorney Jerry Wolfe says Henry has recanted and prosecutors no longer believe he's a credible witness.
