Attorneys for Charles Jason Lively, a McDowell County man who was convicted of first degree murder in 2006 involving the death of Ebb K. “Doc” Whitley of Iaeger, presented evidence in a McDowell County court on Wednesday concerning their client’s contention that he has been unlawfully detained for the crime, according to McDowell County Prosecuting Attorney Ed Kornish.
Senior Status Judge John L. Cummings heard the evidence during the hearing, requested a trial transcript and took it all under advisement, according to Kornish.
The case concerning Whitley’s death was featured in an episode of “Sins and Secrets” last year on the Investigation Discovery channel.

War mayor’s death: Click trial continued
The trial of Earl Click, the man who was charged along with his sister, Rebecca Lynn Hatcher, with the July 17, 2012 murder of Dr. Thomas Hatcher, mayor of War, has been continued according to the McDowell County prosecuting attorney’s office. The trial had been scheduled to start on Monday.
