Va. man found not guilty in W.Va. shooting death

MARTINSBURG, W.Va. (AP) — A 41-year-old Virginia man has been found not guilty in the fatal shooting of another Virginia man in West Virginia nearly two years ago.

The Journal (http://bit.ly/13KXrnm ) reports that jurors found Jonathan Frederick Bennett not guilty of felony murder on Thursday in the March 2011 death of 26-year-old Geronimo Garcia-Cruz of Winchester, Va.

Bennett was tried in Berkeley County Circuit Court. Jurors also found the Charlottesville man not guilty of assault during the commission of a felony, but found him guilty of unlawful assault.

Bennett testified he accidently shot Garcia-Cruz during an altercation at the Martinsburg apartment of his girlfriend at the time.

Bennett is already serving an unrelated federal prison sentence.
